Definitions

 

Saoire Mara Charters

The name of the business, “We”, “Our”, “Us”, operating boat tours on the charter boat MV Caitlín Marie “Boat”.

 

Customer

The person or group, “You”, hiring our boat.

 

Charter/Booking

The agreed hire period for the boat.

 

Skipper

The person authorized by the owner to be in command of the boat.

 


The following terms and conditions are required to ensure the safe operation of our boat and the welfare of passengers and crew on board and to avoid any misunderstanding.

Booking our service is seen as confirmation that the below conditions are acceptable to you and you agree to be bound by them (unless otherwise agreed in writing).


Parking and Boarding

Please arrive in good time before the agreed departure time to allow for boarding. Arriving late does not guarantee the trip will stay out beyond the agreed return time.

 

Free parking is available on the pier at owner’s risk.

 

 

Safety

The maximum number of passengers on board shall be twelve.

We recommend a maximum of 8 for fishing trips.


The boat will be navigated and under the command of the skipper who will be the sole judge in all matters affecting the safety, circumstances and operation of the boat, and reserves the right to cancel the charter and return to port if he feels the safety of the crew or boat may be compromised in any way.
 

The skipper’s reasonable instructions must be adhered to at all times for your own safety and he has the right to cancel the charter at any time due to unacceptable behaviour – the skipper’s decision is final.

 

You will not be allowed onboard if you are under the influence of alcohol and the skipper deems you unsafe to board.

 

Often, seas are encountered which cause the vessel to pitch and roll and great care must be taken by all passengers to avoid injury due to slips, trips and falls.
 

Equipment Loss or Damage

Damage to the boat and equipment should be avoided to the best of your ability. Where the skipper considers any damage caused by you or your group, which exceeds normal wear and tear, you undertake to reimburse the owner of the boat for any damage and or loss howsoever caused.


The owner, skipper or crew shall not be responsible for any loss or damage howsoever suffered by you or your group, in respect of your property or valuables whilst on board or in transit, these are the responsibility of the customer and should be covered on your own insurance.

 

A person who hires rods and reels is responsible for the equipment while on hire, and can be charged in full for any loss or damage beyond normal wear and tear suffered to the equipment while in use.
 

Bookings and Payment

The payment for the hire and use of the boat with skipper shall be the amount shown on our website or otherwise agreed, and must be paid either at the time of booking or in advance of the charter or on the day of charter prior to departure.
 

Cancellations


Cancellations by you.

If you need to cancel or change your booking, please contact us in writing as soon as possible to arrange an alternative charter date.

If a suitable alternative date cannot be achieved, we offer a full refund less booking fees providing you inform us more than 2 weeks in advance of your charter.

Should you cancel within 2 weeks of the charter date, no refund will be given and the full charter fee applies unless a replacement charter can be fulfilled, in which case a full refund less booking fees will be given.

 

If the Customer requests an early return to the pier then the full cost of the trip applies and no refund will be given.

 

Cancellations by us

Occasionally we reserve the right to cancel bookings in advance due to adverse weather conditions, mechanical breakdown or insufficient numbers of passengers, in which case, you will have the option of changing your trip to an alternative time or day or receiving a full refund less any booking fees.

Please allow up to 28 days for the refund of your Payment to be processed, especially during busy times.

 

Please ensure that your details are correct at the time of booking so that you can be contacted in case of cancellation.

 

The skipper reserves the right to return to port if he deems passengers unfit due to intoxication, physical disability, mental disability or aggression in which case no refund will be given and the full charter price will be due by you.


We cannot be held liable for any consequential loss incurred by you or your group if we have to cancel or alter the trip.

 

 

Gift Vouchers

Gift Vouchers are valid for 5 years from the date of purchase and CANNOT be refunded.
The Voucher can be redeemed against a more expensive charter, the difference to be paid on the day.
Charters get booked up quickly on a first come first served basis, especially in summer. Therefore it is best for the recipient to book a date promptly upon receipt of their Voucher.
All charters are weather dependant and if the sea is too rough the trip will be cancelled. In this event the recipient can simply choose another available date.


You undertake to ensure that each member of your group is acquainted with and agrees to the terms of this agreement and that no claim of any nature shall be brought against the owner, skipper or crew or any servant or agent of Saoire Mara Charters by you or any member of your group.


You should inform the skipper in advance of any medical condition of any of your group.
 

Saoire Mara Charters has no responsibility for the content of other third party websites of which links appear on our website or for the actions/inactions of the owners/operators of such sites. We make no representations or warranties in relation to such sites or any services provided on or through those sites or the providers of those services.
